Burke said he was overwhelmed and confused after a May 2005 meeting with federal authorities, including Robert Calvert, then an agent with the Defense Criminal Investigative Service.

Burke said he did not know the exact purpose of the meeting and did not have an attorney. Calvert quickly became accusatory, said Burke, who also said the agent told him he'd become a pawn in an illegal scheme engineered by retired Army Col. Tom Spellissy.

Burke said at one point Calvert said: "Words to the effect of,'We know where you live, and we know where your family lives.' It was very threatening."

What an idiot.  He should have gone straight to his attorney.  I can't believe Burke hasn't withdrew his plea.

Today, Judge Whittemore ordered the government to respond to all motions by 5pm October 31, 2007.  He gave them 48 hours.  This is unbelieveable.  I wonder why the judge gave them another chance to reply to the motions.  If they do respond, I can't wait to hear what McGuire and Cox will say in their response.

This was taken from Spellissy's Motion to Strike.  This is just plain wrong.  How can the government do this and get away with it.
 

It is without question that Captain John Tutterow and at least one other military officer tampered with Defendants’ witness, Sergeant First Class Landers. The Assistant United States Attorney (AUSA) admits that he was part of the witness tampering. The AUSA had no legal authority to interfere with Sergeant Landers’, who was under subpoena of this court or interfere with Landers’ legal representative at Fort Bragg concerning the execution of the subpoena without the knowledge of the court.

Federal Rules of Criminal Procedure, Rule 17, Subpoena, (2) Quashing or Modifying the Subpoena, states "On motion made promptly, the court may quash or modify the subpoena if compliance would be unreasonable or oppressive."

According to Rule 17, the court may quash or modify the subpoena not the United States Army acting in concert with the AUSA which was unknown to us until we received the Government’s response. If the AUSA was aware of issues surrounding the subpoena it should have been brought to the attention of the Federal Circuit Judge, especially after Judge Whittemore had already warned the Government about interfering with witnesses when defendants were preparing for the Franks Hearing. The Court should compare Tutterow’s letter to what the AUSA is saying because Tutterow’s letter contradicts what the AUSA is alleging. The Tutterow letter tells Defendants trial lawyer that he hopes he can resolve the issue without involving the US Attorney [Tampa]. However, the AUSA states in the Government’s response that he was in contact with Tutterow (May 2nd, 2006) upon receipt of the subpoena for Sergeant Landers. This is the day before the letter was written. If the AUSA knew of the letter and talked to Tutterow, then, why would Tutterow want to work with the trial lawyers without involving the AUSA? The reason is because Tutterow wanted to know what the Defendants were going to ask Sergeant Landers so that Tutterow could then report it back to the AUSA or USSOCOM lawyers. The Government wanted knowledge of Defendants attorney client privileged work product. The Government alleges that the letter was faxed to Defendants’ attorney. The Government offered no proof of this. Defendants filed a sworn affidavit contradicting the Government’s position on this, no fax was received. Although the Government alleges that the AUSA spoke with an unnamed previous defense attorney, even if true, it does not excuse the AUSA’s conduct in not following the law, Rule 17. Once again the Government is changing the underlying facts of this case.

This unethical behavior by the Government is persistent throughout the whole case. It is plainly the Government’s fault for ordering Sergeant Landers not to appear as a 4

witness for a criminal trial. By the way, the Government had no issue with Colonel Rupp appearing as a Government witness.

It looks like in Tampa if you get indicted; you are guilty.  This is the Republican leadership at its best.  Spellissy is either a democrat, Irish or Italian or a combination.  After reading all of this I guarantee that my sons will not join the Army.  He obviously pissed off the brass.

Spellissy is all Irish.  His parents were born there.  It is such a shame that he has had to go through all of this.  He is a great man who loves this country and would NEVER hurt it.

Thanks Erin.  Now we know that Spellissy is Irish-Catholic.  I assume he is Catholic because he played basketball in high school at Clearwater Catholic.  He certainly has an interesting background since he was allowed access to British and Israeli secrets and through these threads it looks like he worked with them.  Not to many Irish Catholics are pro- British and Israeli.  He could make a lot of money by selling out the Brits and Isrealis!  However, given all the good things that are said about him in all these Blogs and that he is a West Point graduate, he probably wouldn't do that.   I do find this interesting and perhaps facinating.  Does anyone know what ever happened to the book he was writing?

Tom would never do anything to hurt this country or betray it in any way at all.  Even after what this country's government has done to him he still has his "support the troops" ribbon on his car and would do anything for any soldier.  His loyalty to his country will not waver, I know this.  Not sure what's going on with the book he's writing.  I'm guessing he's waiting to see what's going to happen with his sentence.  Don't know officially though.  And you got the Catholic thing right.  You can find him at mass with his wife and kids every Sunday.

Erin - please bigstop giving out Spellissy's personal info on this thread.  Joey, don't know what you are up to but I can tell  you that he isn't selling anyone out to include our allies.  Spellissy didn't even sell out General Brown when the Feds tried to cut a deal with him.
